Daniel McClean

Daniel is a leading international art attorney who practices law both in California (as a partner at Cypress LLP) and in England (as a consultant to the London law firm, Howard Kennedy LLP).

Daniel’s advises galleries, dealers, advisors, artists, estates, private collectors, museums and foundations across the world. He negotiates and structures high-value and complex art transactions. He advises on disputes and litigation involving art and cultural property, including relating to authenticity, ownership, export, sale and agency. He also regularly works with artists and artists’ estates including on commissioning agreements and on protecting and licensing their intellectual property.

Daniel has a reputation for being a deal-maker and for providing strategic advice tailored to the needs of his art world clients. He worked in art galleries in New York and Tokyo before practicing law. He is a member of the International Bar Association (Arts and Cultural Heritage Law Committee) and speaks regularly on art law issues at conferences. He also lectures on art law; including at Loyola Law School (Los Angeles).

  • Advising a client in cross-border litigation over ownership of the Basquiat painting ‘Humidity’ following the Inigo Philbrick fraud
  • Advising a client in copyright related litigation over its possession of a valuable painting by Glenn Brown
  • Restitution of a valuable Nazi-looted artwork to Jewish heirs which was then sold by a premier auction house
  • Structuring the sale (including escrow) of valuable contemporary artworks on the secondary market
  • Negotiating consignments and third party guarantees with auction houses
  • Negotiating artist’s representation agreement for an artist with a leading global art gallery
